Bodycam Footage Of Chaos Erupting After Police Arrest Captain for BUI.
On May 26, 2023, at approximately 1930 hours, an officer with the Florida Fish and Wildlife Commission was on water patrol in a marked patrol vessel in the area of Haulover Sandbar located in Miami-Dade County. The officer observed an individual, identified by a Florida Driver’s License, operating a blue 33-foot vessel exiting the Haulover Sandbar. Upon conducting a vessel stop to perform a boater safety inspection, the officer discovered the following signs: a strong odor of an unknown alcoholic beverage emitting from the individual's face and breath, glassy eyes, a flushed face, droopy eyelids, stuttering, slurred and muffled speech, and the use of the vessel to brace while retrieving the required safety equipment, indicating a lethargic manner.
As the officer requested to see the fire extinguisher, they noticed a trash bag overflowing with empty “High Noon” cans and other alcoholic beverages hanging from the rear center console, as well as several bottles of liquor on the floor near the port gunnel. Based on these observations, the officer asked the individual to perform Standard Field Sobriety Tests (SFSTs) to ensure they were safe to operate the vessel, which the individual declined.
Due to the observed clues and cues, the individual was placed under arrest for boating while normal faculties impaired and was transported to the Miami-Dade Police Department Pelican Harbor Office to provide a breath sample, which was refused. The individual was charged with the following:
• 327.35(1)(a) State Statute: Operating a Vessel While Normal Faculties Impaired
• 327.359(5) State Statute: BUI, Refusal to Submit to 2nd or Subsequent Test (Breath Test)
The individual had a prior refusal in 2012.
