The employer must obtain a labor certification from the Department of Labor (DOL), which involves proving that there are no qualified U.S. workers available for the job. The processing time for PERM certification can vary widely, taking anywhere from 12 to 18 months. 2. **I-140 Petition**: Once the PERM certification is approved, the employer can file an I-140 Immigrant Petition for Alien Worker with the U.S. Citizenship and Immigration Services (USCIS). The processing time for the I-140 petition can range from approx. 15 days if using Premium Processing, to 6 months if using regular processing. 3. **Consular Processing or Adjustment of Status**: The final step depends on whether the applicant is outside or inside the United States.
