The man had married a second woman while his first wife was still alive, but the first wife later got the ex parte decree of divorce set aside. The Supreme Court ruled that if exparte divorce decree has been granted and thereafter husband remarried then the second marriage will be valid and it won't be bigamy under section 494 ipc even if first wife has got set aside the exparte divorce decree.
